Cancellation Policy
Effective Date: September 1st, 2025
This Cancellation Policy outlines the terms and conditions under which customers may cancel their orders and receive refunds for deposits made through the Belgravia platform.
1. Purpose & Scope
This Cancellation Policy (“Policy”) governs cancellations, credits, and refunds for orders placed through Belgravia’s website and checkout (the “Services”). It is incorporated by reference into the Terms & Conditions and the Legal Disclosures (together, the “Agreements”).Control. If there is a conflict regarding deposit or refund outcomes, this Policy controls. For all other matters, the Terms control.
2. Key Definitions
Capitalized terms not defined here have the meanings in the Terms or Legal Disclosures.
- 1.Deposit: A non-refundable commitment fee you pay at checkout to reserve a vehicle; applied in full toward the Belgravia-collected portion of your Total Due at Signing (the “Total Due”).
 - 2.Secondary Deposit: If collected, the additional amount collected by Belgravia after lender approval and after you elect to proceed, equal to the remaining Belgravia-collected portion disclosed in your Payment Agreement, minus amounts already paid toward that portion (including the Deposit). It is not an additional fee.
 - 3.Designated Lender / Approval: The lender identified in your deal; “Approval” means credit approval by that lender.
 - 4.Vehicle Unavailable: Before contract signing and through no fault of the customer, the reserved vehicle becomes unavailable (e.g., sold elsewhere, pulled by dealer, inventory error), including where the dealership fails or refuses to provide the specified VIN or a Substantially Similar unit at the displayed price within a commercially reasonable period (72 hours).
 - 5.Substantially Similar (for Vehicle Unavailable): A vehicle of the same model and drivetrain with a comparable trim/package, an MSRP within ±$500 of the reserved unit, mileage within 250 miles, and comparable exterior/interior colors. Customer is not required to accept different body style or material changes (e.g., leather vs. cloth).
 
3. General Rule (Non-Refundable)
Deposits (including any Secondary Deposit) are non-refundable, except as expressly provided in §4 and §6(C), or where required by applicable law or card-network rules. All refunds/credits under this Policy apply only to Belgravia-collected amounts; Belgravia does not collect or hold dealer-bound funds. Nothing herein waives non-waivable card-network rights. The good-faith dispute step in §9 is encouraged but not required to exercise any card-network rights.
4. Vehicle Unavailable
The 72-hour period is tolled while you are considering a dealer-proposed Substantially Similar VIN; you will have 24 hours from receipt to accept or decline in writing. Belgravia’s refunds and credits under this Policy apply only to Belgravia-collected amounts. Belgravia does not reimburse dealer-bound funds. Belgravia is not liable for dealer misstatements or changes in vehicle condition, mileage, or pricing unless Belgravia had actual knowledge and failed to act in good faith. Belgravia is not the dealer’s agent and is not liable for dealer conduct absent actual knowledge of a material issue and failure to act in good faith. If, before contract signing, the reserved vehicle becomes Unavailable through no fault of yours, you may choose one of the following remedies:
- •Full refund of the Deposit and any Secondary Deposit to the original payment method; or
 - •Transfer of the Deposit(s) to another vehicle available on Belgravia.
 
5. Customer-Initiated Cancellation (Change of Mind)
If you cancel for reasons not caused by Belgravia, the dealership, or the Designated Lender, the Deposit and any Secondary Deposit remain non-refundable. You may request that non-refunded amounts (if any) be credited toward a different vehicle prior to signing, subject to availability and program changes.
6. Approval, Incentives, and Terms Outcomes
- •Lender Declines / No Approval. If the Designated Lender does not approve your application, your Deposit is credited in full toward another vehicle before contract signing. No refund. Any Secondary Deposit will not be collected.
 - •Approved on Displayed Terms (Buyer Guarantee). Once the Designated Lender approves your credit on the displayed terms, Belgravia guarantees that Belgravia-collected amounts will not increase and will be fully credited to your Total Due, and Belgravia will coordinate with the dealership so that dealer-bound amounts at signing match the checkout itemization. If the dealership proposes additional charges not disclosed at checkout, you may cancel and receive a refund of Belgravia-collected amounts (Deposit and any Secondary Deposit).
 - •Approved on Different Terms (Belgravia does not match). If the Designated Lender approves you on terms different from the displayed amounts and Belgravia does not adjust to match the displayed Total Due/Estimated Monthly Payment, you may cancel. Your Deposit will be credited in full toward another vehicle before signing, and any Secondary Deposit will not be collected. If a Secondary Deposit was collected before the different terms were identified, that Secondary Deposit will be refunded or credited at your election.
 - •Program/Data Corrections (Non-Incentive). If a non-incentive data or program correction is required before signing, Belgravia will honor the displayed Total Due/Estimated Monthly Payment. If you decline to proceed while the vehicle remains available at those honored terms, your Deposit is non-refundable.
 - •Dealer/Manufacturer Incentive Misclassification. Final incentive eligibility is determined by the dealer/manufacturer. If a correction would increase your price before signing, Belgravia will either honor the displayed amounts or allow cancellation consistent with §4.
 - •Customer Incentive Ineligibility. If incentive eligibility was assumed based on information you provided and you are later found ineligible, Belgravia is not obligated to match the displayed amounts. You may cancel; the Deposit is non-refundable, and any Secondary Deposit will not be collected.
 
7. Secondary Deposits (Post-Approval)
Refund method. Refunds under this section are issued to the original payment method, unless prohibited by processor rules or law.
- •Timing & Amount. A Secondary Deposit is collected only after Approval and your election to proceed. The amount equals the Belgravia-collected portion disclosed in the Payment Agreement, minus any prior Deposit(s).
 - •Application. Applied in full toward your Total Due; not an additional fee. Outcomes (summary).
 - •Vehicle Unavailable (no customer fault) → Secondary Deposit refunded or transferred (§4).
 - •Customer cancels while vehicle remains available at displayed/honored price → Secondary Deposit non-refundable (§5, §6(D)).
 - •Approval rescinded / deal cannot be finalized on displayed terms and Belgravia does not honor → Secondary Deposit refunded or credited (§6(B)–(C)).
 
8. Process; How to Cancel; Verification; Timelines
- •How to Cancel. Email hello@leasebelgravia.com with your name, order ID (VIN if available), and reason for cancellation.
 - •Verification. Belgravia may require identity and payment-method verification to protect you against fraud.
 - •Refund Timing. Where a refund is due under this Policy, Belgravia will process it within 3–5 business days after confirmation. Posting times depend on your issuer/bank. Refunds are issued to the original method of payment unless prohibited by processor rules or law.
 
9. Good-Faith Dispute Step; Chargebacks & Card-Network Rights
- •Good-Faith Step. Before initiating a chargeback or arbitration, email disputes@leasebelgravia.com with your order ID and a brief summary. Belgravia will respond within 5 business days. This step is encouraged but not required to exercise your card-network rights.
 - •Card-Network Rights. Nothing in this Policy limits your rights under applicable law or card-issuer/card-network rules. Belgravia may dispute chargebacks opened in error. Any attempted reversal contrary to this Policy and card-network rules may constitute a material breach; after a good-faith resolution process, Belgravia may seek recovery of improperly reversed amounts and reasonable costs. This informal step does not shorten any limitations period and does not restrict your ability to open a chargeback where permitted by card-network rules.
 
10. Fraud, Abuse, or Misuse
Belgravia may deny refunds if an order involves fraud, abuse, or misuse (e.g., repeated bad-faith reservations, materially false information, payment instrument fraud). This does not limit any other remedies available at law or in equity.
11. Liability Cap; No Consequential Damages; Exclusions
- •To the maximum extent permitted by law, Belgravia’s liability relating to cancellations is capped at the total Deposit(s) for the affected order and excludes indirect, incidental, special, consequential, exemplary, or punitive damages.
 - •Carve-out (Buyer Guarantee). This cap does not limit Belgravia’s obligation under §6(B) to refund Belgravia-collected amounts (Deposit and any Secondary Deposit) if you cancel because the dealership proposes additional charges not disclosed at checkout.
 - •Exclusions. The foregoing limits do not apply to willful misconduct, gross negligence, bodily injury, or data-security incidents caused by Belgravia’s failure to use reasonable safeguards, or to non-waivable statutory rights.
 
12. Reservation of Rights to Decline or Cancel
Belgravia may, in its sole discretion and prior to contract signing, decline to proceed with or cancel an order for compliance, fraud-prevention, availability, operational, or business reasons. If Belgravia cancels without customer fault while the vehicle remains available, Belgravia will provide a full refund of all Deposit(s) collected by Belgravia for that order.
13. Relationship to Other Policies
This Policy is incorporated into the Terms & Conditions and Legal Disclosures. If there is any conflict regarding deposit or refund outcomes, this Policy controls. For all other matters, the Terms control.
14. Version Control; Changes
Belgravia may update this Policy to comply with law, card-network rules, or business needs. For each order, the version of this Policy in effect when you place or modify that order governs deposit/refund outcomes for that order. Later updates apply prospectively.
